GMB, the union for council workers, has responded to the Teesside Employment Tribunal’s decision to find in favour of a Middlesbrough Council worker who was unfairly sacked by the council in 2024.
The tribunal, presided over by Employment Judge Jeram, found that Mr Brian Foulger was unfairly dismissed for simply carrying out his trade union duties, and ordered that he be reinstated to his role as a Senior Transport Officer.
Mr Foulger, who had been employed by Middlesbrough Council since June 2004, was also a GMB Union convenor.
The dismissal stemmed from his involvement in representing a council worker, which would come under the scope of his trade union duties.
Neil Sharples, GMB Legal Officer, representing Mr Foulger, said: This decision marks a significant victory for Mr Foulger and the GMB and underscores the importance of fair employment practices.
The tribunal's ruling sends a clear message to employers about the protection of workers' rights under UK employment law.
Mr Foulger, said: “The tribunal's decision demonstrates that the actions taken against me by Middlesbrough Council were totally unjust.
“This ruling is not just a personal victory but a significant win for all union reps who stand up for fairness and equality in the workplace for their members.
“I hope this judgement stops the council in their tracks when trying to treat union reps in such a vindictive way for just carrying out their union duties.”
